Fucked up bit is the Republicans are all cry-bullies, so if the Dems tried to mirror their tactics and played dirty they would clutch their pearls and be like "omg look the Dems don't care about le constitution!" despite spending the last year doing nothing but shitting on the constitution. The law, the constitution, the spirit of America, is only to be respected when it aligns with Republican interests.
That's not to say the Dems are perfect, they're politicians like anybody else, I'm just saying. Also OP scenario is unrealistic because they'd probably try (and fail) to nab him on conflict of interest instead of being foreign-born.
